All You Need To Know About Chief Minister of A State

Introduction

The Chief Minister's role in the state is similar to the Prime Minister's post in the federal government. The Chief Minister is chosen by the Governor in accordance with Article 164 of the Constitution. The heads of the parties that garnered the highest support during the assembly elections are chosen to serve as the state's chief minister. While the Chief Minister has actual executive authority, the Governor only has formal executive authority.

The Process For Appointing The Chief Minister

•    The chief minister is appointed by the governor and is often the head of the house or the leader of the largest coalition.

•    In the absence of a clear majority for any party, the governor may exercise situational judgment. He may designate a leader to serve as chief minister before displaying his majority on the parliament's floor.

•    However, if the ruling party nominates someone, the governor is forced to select that person. If the chief minister passes away without a replacement, the governor may choose one at his discretion.

•    The CM loses his status as CM if he does not join either house within six months. The CM is chosen by the governor, who can only remove him once he has a majority in the house.

•    The party or coalition that wins a majority in the House after the general election for the State Legislative Assembly chooses its leader and notifies the Governor. He is subsequently given the title of Chief Minister and told to appoint a Council of Ministers by the Governor.

•    When there is no obvious majority in the State Legislative Assembly, the Governor frequently seeks the head of the single largest party to form a government.

The Chief Minister's Term

•    The Chief Minister is appointed by the governor and has an undetermined term.

•    As long as he has the backing of the majority in the legislature, the governor cannot remove him from office.

•    A vote of no confidence in him by the State Legislative Assembly is another option for removing him from office.
